Eligibility for Divorce

In order to file for divorce in the state of California, at least one of the parties must have been a resident of California for at least six months. He must also have been a resident of the county in which the divorce is being filed for a period or three months before the filing.

In California, you can file for divorce based on two grounds. You can file for divorce based on irreconcilable differences in which you admit that the two of you have differences that cannot be resolved, and on grounds of insanity.
