In order to file for divorce in the state of California, at least one of the parties must have been a resident of California for at least six months. He must also have been a resident of the county in which the divorce is being filed for a period or three months before the filing.
In California, you can file for divorce based on two grounds. You can file for divorce based on irreconcilable differences in which you admit that the two of you have differences that cannot be resolved, and on grounds of insanity.
One of the most important aspects of any divorce is the division of assets. California is a community property state, which means that in most cases, the property that is accumulated by the spouses during the marriage while living in California is considered community property. That means that the property is eligible for division between the two of the spouses.
This community property does not include separate property, like property that was inherited by one of the spouses, or gifted to him or her. Separate property will include all of the property that was owned by the person before the marriage.
A California court will also consider a number of factors, including the standard of living of the spouse seeking alimony, the capacity of the spouse seeking support to get a job to sustain him or her, and other factors before it determines alimony payments. Speak to an Orange County divorce lawyer at the Citadel Law Corporation to determine how much alimony you might have to pay or are eligible for.
Under California law, either the father or mother is eligible for custody, and the state makes no discrimination based on gender. There are a number of arrangements that parents can choose including joint custody, sole custody or joint legal custody of the child.
