Child Custody in California

In California, the system allows for a number of different types of arrangements that are mainly geared at preserving the best interests of the child. In California, for example, you can have joint physical custody, joint legal custody, sole custody and other types of child custody arrangements.

In a joint custody arrangement, the parents will have joint physical and legal custody of the child. In an arrangement like this, the child will live with each parent according to a preset schedule, and the parents will also have joint authority to make legal decisions about the child's health, education, and other issues.

In a joint legal custody arrangement, only one parent will have physical custody of the child, but the parents may agree to share legal responsibility for the child.

In a sole custody arrangement, one parent will have sole physical & legal custody of the child.

In deciding these cases, a California court will primarily take into consideration the best interests of the child. In other words, the court will agree only to an arrangement that prioritizes the interests of the child above all else. A California court will not automatically grant custody to the mother. There is no discrimination based on gender of the parents.

At the time of separation, you will be required to create a parenting plan, which must be submitted to a court for approval. If you are unable to come up with a parenting plan that satisfies both of you, the court will step in to intervene.
